Welcome to The Houston Patch Co. (referred to herein as “the Company,” “we,” “us,” or “our”). By accessing our website, custompatcheshouston.com, or by placing an order for custom manufactured goods, you agree to be bound by the following Terms and Conditions. These terms govern the relationship between The Houston Patch Co., a specialized industrial textile manufacturer located in Houston, Texas, and you, the Client.
1. Acceptance of Terms
By engaging our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
2. Manufacturing & Production Standards
Unlike “patch brokers” or promotional resellers, The Houston Patch Co. is a direct, in-house manufacturer. All production is executed on our commercial, multi-head Tajima embroidery equipment and specialized shuttle looms located at our facility off Beltway 8 in Houston, Texas.
Material Specifications: We utilize industrial-grade materials, including 40-weight Madeira poly-neon thread and heavyweight 12-ounce twill substrates.
Industrial Compliance: For clients in the energy, petrochemical, and maritime sectors, we offer specialized Nomex® flame-retardant (FR) thread. It is the Client’s responsibility to specify the need for FR-compliant materials at the time of quoting.
Hand-Digitizing: Every design is hand-digitized by our local Houston operators. We do not use automated “auto-punch” software. The Client acknowledges that minor variations in stitch direction and density are a result of this manual engineering process designed to ensure structural integrity on heavy workwear.
3. Intellectual Property & Artwork
Client Ownership: The Client warrants that they own the rights to, or have obtained all necessary permissions for, any logos, trademarks, or designs submitted for manufacturing. The Houston Patch Co. assumes no liability for trademark infringement resulting from the production of Client-supplied artwork.
Digitizing Files (DST/PXF): While the Client owns the physical patches produced, the technical embroidery files (DST, PXF, and EMB formats) created by our shop remain the intellectual property of The Houston Patch Co. These files represent our proprietary manufacturing “blueprints” and stitch paths.
Marketing Use: Unless otherwise requested in writing, the Company reserves the right to photograph and display manufactured patches on our website and social media as examples of our manufacturing capabilities.
4. Industrial Use-Case & Environmental Disclaimer
The Houston Patch Co. builds gear for the Texas Gulf Coast environment. However, the Client must adhere to the following environmental guidelines:
Adhesive Backings: Our 3M™ 300LSE industrial adhesive is designed for high-performance bonding. However, the Client acknowledges that standard iron-on (heat-activated) adhesives may fail or delaminate when exposed to Houston’s extreme humidity and ambient temperatures exceeding 100°F.
Safety Compliance: We strongly advise against the use of iron-on or adhesive backings for PPE (Personal Protective Equipment) used in refinery or high-heat environments. For these applications, Sew-On backing is the only recommended method to ensure safety compliance and garment integrity.
5. Quotes, Payments, and Net-30 Terms
Quote Validity: All quotes provided via our website or email are valid for 30 days.
Payment Terms: Standard orders require 100% payment upfront before the needles move on the shop floor.
B2B & Government Accounts: We accept Net-30 Purchase Orders (POs) from established local government entities, Port of Houston vendors, and recognized companies within the Houston Energy Corridor, subject to credit approval.
6. Production Timelines & Shipping
Lead Times: Standard production cycles are 7 to 14 business days from the date of proof approval. These timelines are estimates and may vary based on volume and material availability (e.g., specialized Nomex® thread colors).
Local Houston Delivery: We offer next-day local shipping within the Greater Houston area.
Logistics Hubs: We are experienced in routing bulk freight deliveries directly to the Port of Houston, commercial docks, and logistics hubs. The Client is responsible for providing accurate gate protocols for restricted-access delivery sites.
7. Returns, Cancellations, and the “Custom Goods” Policy
Because we manufacture custom, one-of-a-kind items to your specific brand requirements, we do not offer a “standard” return policy.
Cancellations: Orders may be canceled for a full refund only before the digitizing process has begun. Once a design has been digitized and a proof provided, a 20% engineering fee will be deducted from any refund.
Manufacturing Defects: If a product is found to have a genuine manufacturing defect (e.g., incorrect thread colors or structural unraveling), we will replace the defective units at no cost, provided the claim is made within 10 business days of delivery.
Color Matching: We utilize a closed-loop Pantone (PMS) matching system. While we strive for 100% accuracy, the Client acknowledges that slight variations may occur between digital screen representations and physical thread colors.
8. Limitation of Liability
The Houston Patch Co. shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products. This includes, but is not limited to, the failure of a patch to adhere to a garment, or any safety violations resulting from the Client’s choice of improper backing or thread for a specific industrial environment.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas. Any legal actions or proceedings arising out of these terms shall be brought exclusively in the courts of Harris County, Houston, Texas.
