Texas Consumer Privacy Rights (TDPSA)
Do Not Sell or Share My Personal Information
At The Houston Patch Co., our primary business is engineering and manufacturing industrial-grade custom patches. We are a factory, not a data broker. Whether we are outfitting a 500-man refinery crew in the Energy Corridor or supplying tactical PVC patches to local Harris County law enforcement, we treat your corporate data, personal information, and intellectual property with the same rigorous standards we apply to our manufacturing floor.
In strict compliance with the Texas Data Privacy and Security Act (TDPSA), we provide this comprehensive framework to explain your privacy rights, how your data interacts with our production processes, and how you can exercise your right to opt out of data sharing.
1. Understanding the Texas Data Privacy and Security Act (TDPSA)
The TDPSA is a comprehensive state privacy law designed to give Texas residents and business entities control over their personal data. As a business operating a physical manufacturing facility off Beltway 8 in Houston, Texas, we are fully committed to upholding these regulations. The law mandates transparency regarding data collection, processing, and the sharing of information with third parties. It also grants you specific rights to access, correct, or delete the data you entrust to us during the quoting and manufacturing process.
2. Your Specific Privacy Rights Under Texas Law
As a Texas consumer or a B2B procurement partner operating within the state, the TDPSA grants you the following fundamental rights regarding your data:
- The Right to Confirm and Access: You have the right to confirm whether The Houston Patch Co. is processing your personal data and to access that data.
- The Right to Correction: You have the right to correct inaccuracies in your personal or corporate data, taking into account the nature of the data and the purposes of the processing.
- The Right to Deletion: You have the right to request the deletion of personal data provided by or obtained about you. (This includes requesting the purging of your vector artwork and DST/PXF digitizing files from our local servers).
- The Right to Data Portability: You have the right to obtain a copy of your personal data in a portable, readily usable format that allows you to transmit the data to another entity without hindrance.
- The Right to Opt-Out: You possess the absolute right to opt out of the processing of your personal data for the purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.
3. The “No Middleman, No Data Broker” Guarantee
The custom apparel industry is unfortunately filled with “internet brokers” who outsource production overseas and frequently monetize customer email lists by selling them to third-party marketers.
The Houston Patch Co. does not sell your personal information. We have never sold our client lists, and we never will. Your data is used exclusively to facilitate the manufacturing of your custom embroidered, PVC, woven, or Nomex® FR patches. Because we own our Tajima embroidery machines and operate entirely in-house, your sensitive brand assets and contact information never leave our secure Houston network to be shopped around to overseas factories.
4. The Data We Collect on the Shop Floor
To provide you with factory-direct pricing and accurate manufacturing, we only collect data that is strictly necessary for production and logistics. This includes:
- Identifiers: Your first and last name, corporate email address, and phone number (crucial for communicating production updates or requesting digitizing proof approvals).
- Commercial Information: Your shipping and billing addresses. If you are requesting delivery to a secure location like the Port of Houston or a petrochemical plant, we collect necessary gate protocols or delivery instructions.
- Digital Assets: Your uploaded vector artwork, logos, and the resulting proprietary machine files (DST/PXF) engineered by our digitizing team.
- Financial Data: Payment information, which is processed through heavily encrypted, PCI-compliant third-party gateways. We do not store raw credit card numbers on our local servers.
5. How We Share Data for Logistics & Fulfillment
While we do not sell your data, we do share specific, limited information with trusted Tier-1 service providers to fulfill your industrial contract. This is a functional requirement of the manufacturing and delivery process.
- Freight and Couriers: We share your name, company name, and physical address with shipping partners (such as UPS, FedEx, or local Houston couriers) to ensure your gear arrives on time.
- Payment Processors: We transmit necessary billing details to our secure financial partners to authorize your transaction or process Net-30 Purchase Orders.
- Legal Compliance: We may disclose information if required to do so by law, or in response to a valid subpoena or court order originating from Harris County or other recognized legal jurisdictions.
6. How to Submit a TDPSA Opt-Out or Deletion Request
If you wish to exercise your right to opt out of any potential future data sharing for targeted advertising, or if you want your account and digital manufacturing assets permanently deleted from our system, please submit a formal request to our compliance team.
You may submit your request via any of the following methods:
- Email: Send an email to support@custompatcheshouston.com with the subject line “TDPSA Privacy Request”.
- Phone: Call our shop floor directly at (713) 919-7672 during standard business hours (Monday – Sunday, 8:00 AM – 7:00 PM CST).
- Mail: Send a written request to our physical facility:

Attn: Data Compliance Officer
Houston, TX
7. Our Verification Process
To protect your corporate identity and prevent unauthorized access to your data, we are required by law to verify your identity before processing a deletion or access request. When you submit a request, we will ask you to confirm at least two pieces of information already on file (such as a recent Order Number, the email address used for the quote, or the specific patch style ordered, e.g., “3D PVC” or “Leather”). We will process all verified requests within 45 days of receipt.
8. Authorized Agents
Under the TDPSA, you may designate an authorized agent to submit an opt-out request on your behalf. If you are a corporate entity, your designated procurement manager or legal counsel may submit this request. We will require written permission or a valid power of attorney to verify the agent’s authority before processing the request.
9. Non-Discrimination Policy
The Houston Patch Co. operates with total transparency. We will not discriminate against you for exercising any of your rights under the Texas Data Privacy and Security Act. If you choose to opt out of data sharing or request data deletion, you will not be denied goods or services, nor will you be charged different prices or provided a lower quality of manufactured goods. Your Tajima production lead times and industrial quality will remain identical.
